    2021年度も2020年度に引き続き、「デジタル化の進展によって生じる集団的労使関係法の変容を考察するという課題を解決する」という目的を達成するための前提作業として、比較法的検討の対象国であるドイツにおける労働関係法令(労働者発明法等)の翻訳作業に取り組み、書籍として刊行した。
    また、プラットフォーム労働に焦点を当て、プラットフォーム労働という新しい働き方が増加しているなかで、これへの対応をヨーロッパの主要国であるドイツとフランスとの比較で日本と韓国の違いを分析した。具体的には、労働組合の関係者、労働政策審議会の会長、経済法の研究者等へのヒアリング調査を行った。
    最後に、日本における労働条件の集団的規律法理や団体行動法理に関する分析を進め、数本の論考を公表した。

    Considering changes in labor-management relations (diversification of (i) work style (especially the trend toward treating workers as independent contractor); (ii) the way of using labor force; (iii) interests of workers; (iv) labor union; and (v) concerted activities), this study reviews (i) the meaning of “employee” exercisable the right to organize, bargain and act collectively; (ii) the meaning of “employer” in collective labor relations (especially “employer” having duty to bargain collectively); (iii) the way to reconcile the rights and freedom of employees (union members), especially right to participate and freedom to join and leave union, and the rights of labor union; (iv) the way to decide work conditions (especially those of non-typical workers) collectively by labor union; (v) the scope of rights to organize and act collectively (especially justifiability of propaganda activities of labor union) and then reconstructed collective labor law theory.

    This research project tries to reconstruct Industrial Relations Law, especially the legal system for collective agreements. This research compares Japanese legal system with that of Germany.
    The achievements of this research consist of the following three points: 1. We should establish the purpose of the legal system for collective agreements concretely and set the requirements and effects of collective agreements to suit that purpose. 2. Those requirements and effects should be designed according to the various roles of labor unions. 3. The right to collective bargaining of labor unions is not adequate to guarantee collective agreements to have decent contents.
