    本研究課題は、和平等の合意を保障するために供出あるいは交換されていた人質という仕組みの在り方を、中世にまでさかのぼって理論的に検討し、さらにそれが近世から近代にかけて変質した要因を解明することを目的として実施した。二年目となる本年度は、初年度に実施した事例調査をふまえ、年度前半は仮説の構築、年度後半に社会心理学実験による仮説検証に取り組む予定であった。
    今年度は、まず５月にオンライン・ミーティングを実施し、初年度の研究調査の内容を小括し、仮説構築に向けた検討を行った。具体的には、（１）古代から現代まで変質しつつも存続してきた「人質」という仕組みをどのように定義するか、（２）人質の慣行に共通する基本的な性質（人質を出す・取るための資格等）、（３）人質が合意保証に果たしていた機能についての仮説、（４）人質が機能するための前提条件といった論点について議論を行った。
    以上のミーティングの内容をふまえ、８月にもオンライン・ミーティングを実施し、仮説について社会心理学の視点から議論を行った。本研究課題は国際政治学、国際法学、歴史学といったバックグラウンドを異にするメンバーの共同研究であることから、まずは社会心理学における集団間の葛藤に関する理論および実証について理解を深めた上で、集団間の紛争状態の停止において人質が果たしうる役割について示唆的な仮説のいくつかを検討した。今後はこれらの検討結果に基づき、再度、具体的な事例を見直し、仮説を確定していくこととなった。また実験室実験を用いて仮説検証を行う上での潜在的な障壁についても議論を行った。

    Carl Schmitt's arguments, which vary widely depending on the circumstances, have been described as opportunistic. This study explored the principles that run through Schmitt's doctrines of international law which appear to differ widely. The most important emphasis was placed on the concept of Mittelbarkeit(mediateness). If each individual directly (immediately) realizes the justice and norms he or she believes in, a state of war of all against all will emerge. To prevent this, Schmitt believes that it is the state that mediates justice and norms for each individual, and that such Mittelbarkeit is a fundamental principle of the state law and international law. Such Mittelbarkeit is tied to recognition of the legal status of others.

    Doctrines of International law in the era of the League of Nations have been generally understood as legalism, which considered legal norms as panacea to legal problems and tried to settle all kinds of international disputes through application of international law. According to this understanding, the international politics was born as a denial of the international law doctrine. But in fact, one of the most influential tendencies of international law in the inter-war period focused its attention on the limits of legal norms in international order. It did not consider the application of law as panacea to international problem, but stressed the necessity to make the dynamic system where international disputes would be settled through change of legal norms. In this tendency of international law theory, the thought of international politics was formed.

    This research, in overcoming previous attempts of debunking Westphalian Narrative mainly engaged by historians, introduced the conceptual distinctions between wider and narrower senses of Westophalian Narrative and between function and development of Westphalian Narrive to provide new analytical framework in which Westphalian Narrative should be unthought within the discipline of International Relations. The research provided a critical reconstruction of discursive closure of "International Relations" in the context of structural historical process of epistemic poltics over legitimate interpretation of history.

    There is much talk about ”Kelsen-Renaissance” recently in Germany. This is the first phenomena since the end of the Second World War, which reflect the fundamental transformations of the German science of public law. The “rediscovery” of Kelsen was analyzed from Aspects of 1) method, 2) theories of democracy and 3) Globalization and Europeanization. Fundamental criticism against German Constitutional Court is also new phenomena in German science of public law. Standard bearers of ”Kelsen-Renaissance” are exactly the main force of criticism against this Court. These phenomena were therefore observed also from the above mentioned three aspects. The most important book of criticism against German Constitutional Court, “the court of border violation” was translated in Japanese by our group.

Devising educational methods

  • 講義形式において、なるべく双方向性を採りいれるように努力している。たとえば、重要な問題に関する課題を設問形式で配布し、それについて、教科書等を参照しながら、とりあえずの解答を書かせたうえで、その解答についての問題点を講義の中で論じることで、問題の中心部分を深く考えるように誘導する、という授業形式を採りいれている。このような形式によって、一方向の講義と期末テストという伝統的な形式よりは、主体的な思考の訓練をはじめとする学習効果は上がっているように思われる。ただし、このような形式は、本来、学生がある程度の予習を行ってくることを前提としてのみ、十分に機能するものであるが、現在のところ、その前提は実現できていない。今後の、非常に困難な課題である。
