    The Hakamada Case and the Nabari Poisoned Wine Incident are examples of wrongful convictions in Japan. In both cases, the defendants, who were sentenced to death, consistently maintained their innocence while filing repeated retrial requests over extended periods. Hakamada Iwao eventually achieved acquittal through retrial, whereas Okunishi Masaru died in prison before his retrial was granted. These cases highlight contradictions in the investigation and trial processes, challenges within the retrial system, and the suffering endured by death row inmates and their families. This study examines the similarities and differences between the two cases, providing a structural analysis of the wrongful convictions. Furthermore, it identifies problems within the judicial system regarding retrial petitions and offers concrete proposals for legal reform.
