    本年度は、借上げ公営住宅の規律の不明確（前年度参照）に関して、規定がなされた平成８年時点での建設省（現国交省）見解（平成８年時点の逐条解説の意味）を調査した。
    【借地借家法】当時の転貸借の期間満了時に関する規律（現在も同じ）は、原賃貸人は、正当事由に基づき原契約を更新拒絶したときに転借人に対して明渡請求をなし得るというものである。他方、原賃借人による更新拒絶に関しては、最高裁平成１４年判決が、原契約が共同事業による場合（借上げ公営住宅も同じ）に、原契約の終了を転借人に対抗し得ないとする。なお、この時点で（現在も）、原賃借人の更新拒絶に際した一般的規律は存在していないとされる（調査官解説）。当時、定期借家はない。
    【公営住宅法】公営住宅に関しては、(1)趣旨に沿わないとして定期借家の適用が否定され(平成１２年：平成１９年前後に入居者の居住の安定（困窮が解消されないなら継続入居）を確保した上「期限付き入居」として容認）、(2)建替事業に関して、公営住宅において、入居者の生活の変化させるような事業主体による解約は、正当事由によるとされ、(3)原契約が借地契約の場合に、事業主体が原契約を更新拒絶することは公営住宅の趣旨に反するとされ、事業主体と入居者との関係は正当事由による（昭和４０年建設省回答）。
    【結果】以上、法の規定は、事業主体の原契約の更新拒絶について予定していたわけではなく、建物所有者が正当事由に基づいて原契約を更新拒絶した際に、事業主体が入居者に代わって明渡請求を行うためのものであることが明らかになった。事業主体による原契約の更新拒絶は、公営住宅法の趣旨から禁じられ、入居者との関係は従前通り正当事由による（昭和４０年回答）。これは、逐条解説の記述（国土交通省見解）とも一致する。したがって、下級審判決の判断は、沿革的には誤りに基づいたものであり、最高裁における判断が求められる。

    With regard to the TEPCO radiation disaster, the issue of ‘voluntary evacuees’ and economic loss problems have been considered and publicized. We have also examined the related cases with attorneys at the workshops of Japan Environmental Council and have realized that there has been some disparity between our achievement and the actual case decisions. Relatedly, first, the radiation damage due to the atomic bomb testing in the Pacific Ocean and its remedies have been surveyed as a comparative study. Second, the joint epidemiological study has started in Minamata Disease cases, focusing on the causation issues, and continues to its sequel research, starting from the empirical studies. Third, the recent cases regarding the abandoned chemical gas bombings in China have been analyzed with some fieldwork in Qiqihar.
    The interdisciplinary analysis of the psychological trauma due to the broken communities in the disaster area is still weak and it might be the agenda of the sequel project.

Devising educational methods

  • 講義 （内容・方法）以下のことを心がけている。①「どうすべきか」よりも「なぜそうなっているか」をできるだけ説明すること。②「専門用語」よりも「日常用語」によること。③「知識」よりも「考え方」にウェイトを置くこと。④「簡単な問いかけ」の積み上げによって、「先端の知見」に至ることをできるだけ説明すること。⑤知識の確認の際には、「よくある間違いの例」をあげること。⑥授業日に復習、メモなどの資料整理などをしなければ身につかないことや授業開始5分前に前回の講義の復習をしておくことを強調する等、学習生活面のアドバイスを行うこと。⑦講義の授業回のうち、１回ないし２回を利用して、（ほぼ立論の過程が記述されているレジュメを配布の上）問題演習を行い、個別に添削を行うことによって、受講者各自の認識の癖を確認していただくこと。⑧試験においては、以上のことを確認すること。⑨試験後にはどこを間違えたのか確認してもらうため、詳細な解説・講評を行うこと。

    演習 （内容）グループでの議論を行う力を養うために、以下のことを重点的に指導し、自らも研鑽するように心がけている。①発表時に資料の棒読みにならないこと。②頭で話すべき内容・論理を再現しながら、ゆっくりと発表すること。③議論時には、質問者・応答者だけの会話に陥らないこと。④議論の論理的な整理を適宜行い発表すること。⑤論理の整理に関係することと、価値観の対立に関係することとを区別すること。 （方法）参加者が整理に詰まるたび、疑問に直面するために、頻繁に、議論を行うこと。
